The use of the online services provided by genezic is governed by the terms and conditions set out below. The entire content of the web site, regardless of its nature (text, images, graphic elements) is property of SC Photo Impact SRL, located in Abrud, Aleea Propului, Bl. The use of any content of this site without the written consent of genezic is forbidden and punishable by law. If you continue to use this web site, you agree to be bound by the terms and conditions set out below.

Genezic works strictly as an online agency, which means you don’t have to meet with our staff in order to get the designs that best suits your needs.

1. Definitions and interpretations

1.1 Definitions

• photo impact means SC Photo Impact SRL, located in Abrud, Aleea Plopului, Bl.N, Sc. 1 Ap. 9, Alba county, Romania, registered under J01/260/2008, C.I.F. RO 23378499.
• genezic means the web site owned by Photo Impact, and underlying software and infrastructure which permits the provision of the services
• amendment means that genezic can amend the Terms and conditions at any time, without any prior notice sent to the users. You agree to the amends if you continue to use the web site. Any projects launched before the amendment of Terms and conditions are subject to the Terms and conditions that were valid at the time the project was launched
• client/user means the entity that requests a design and launches a project
• design means a graphic design or image, that the client requires
• project description means a short description of the client’s needs, which helps the designer to better understand the requirements.
• designer means the person who makes the requested design
• user account means an account on the web site, that allows you to benefit from the services

1.2 Interpretations

• a reference to a person includes a reference to a corporation, firm, association or other entity, and vice versa
• the singular includes the plural and vice versa
• a reference to any gender includes a reference to all other genders
• a reference to any legislation includes a reference to any modification or re-enactment of such legislation
• where an expression is defined, another part of speech or grammatical form of that expression has a corresponding meaning

2. Services offered by genezic

• Genezic offers online design services. You can access these services by registering as a user on the web site.

3. Creating a user account

In order to access our services, you must create a user account, agree to the Terms and conditions and be at least 18 year old. The user account allows you to launch projects, modify your contact info, track and edit any launched projects.

If you are using the Services on behalf of your employer, you warrant that you have full authority to enter into this Agreement on behalf of your employer.

4. Privacy

As a visitor on the web site, you can perform some activities without offering personal information. Once you register as user, some data regarding your activity on the site will be stored. We save the details you provide in your account profile, such as email address, phone number, physical address etc. The data you provide will not be disclosed to anyone else, unless we are required to do so by law.

We also collect the following information:

• your IP address
• your browser version and it's capabilities
• your operating system
• the date and time of your visit

5. User obligations

You will only use your genezic account for the purposes of using the services and for no other purpose.

More specifically, you will not use the account to send viruses, spyware, malware or any other types of unsolicited information/data. If you do not comply, genezic has the right to suspend or close your user account.

Genezic claims the right to suspend or delete a user account at any time, with or without prior notice given to the user.

6. Launching a project

When launching a project, you can either guarantee your project or not.

If you choose to launch a guaranteed project, you will be required to pay the amount set for the project, before launching it on the web site. You can pre pay the project using PayPal. Payment will be made on the last step.

If you choose not to launch a guaranteed project, you will only be required to pay at the end of the project, when you receive the design.

Keep in mind that guaranteed projects are treated with priority!

7. Fees

None of the prices on this website contain VAT.

When launching a project, you can select one of the options below:

• Private project (hidden from search engines and unregistered user) cost $10
• Urgent project (project’s length is half the usual length for such a project) cost $ 50

The cost of these two options will be added to the price already set for the project.

Price list:

We reserve the right to refuse a project, provided that the price offered is too low compared to the complexity of that project.

If the project is refused and the client has already made the payment, the entire amount will be reimbursed within 30 working days.

Any commissions/fees/taxes that might occur independent of genezic (such as bank commissions) lie within the client’s responsibility.

8. Renouncing on a project

The client may renounce on the project at any time and the entire amount paid, minus any commissions/fees/taxes that might occur independent of genezic (such as bank commissions), will be reimbursed within 30 working days

9. Supply of designs

According to the type of your project, we will create up to three different designs.

When creating the designs, we may also use images from microstock agencies.

Once you have selected the final design, we have three working days to send you the files and the license for that particular design.

If the project is very complex, the length of the project set by the client may be insufficient. In this case, the administrator may suggest a different length for the project, before approving it. In order to save you from any inconveniences regarding insufficient time, we strongly advise you to request a free design consultation.

If the client requests too many modifications to the design, the time initially set for the project may be excedeed.

10. Types of license

Standard, Extended, All rights.

The client can only use the design for the purpose he purchased it for.

For any other purposes and uses, genezic claims all rights. Your rights to use a design are subject to this license agreement and are conditioned upon your payment to genezic for your use of the designs.

Free designs offered for weekly download are subject to the standard license.

11. Miscellaneous

This agreement is applicable to Romanian laws.

Both the client and genezic will make all necessary efforts to solve amicably any dispute or misinterpretation of the Terms and conditions, through direct negotiations.

If, after 15 days of the unofficial start of these negotiations, client and genezic fail to amicably resolve the disagreement, each may require that the dispute is settled in Alba-Iulia Court, which will have exclusive jurisdiction.

We will not be held responsible for failure to complete the projects on time, if this is due to natural fenomena (earthquake, flood, storm etc.), terrorism, strikes, war, sabotage or other similar circumstances or events that are beyond genezic control.

Genezic has the right to use your company name in order to promote their services on the market, if not otherwise requested in writing.
